A 33-year-old Rosenberg man has been convicted of felony Family Violence Assault after attacking and choking his sister in January. The jury took 30 minutes to convict Jose Nicholas Resendiz.
According to Assistant District Attorney Amber Givens, Rosenberg police officers were called to investigate an assault the evening of Jan. 13. The officers arrived to find Diana Resendiz visibly shaken, but noticed continuing sounds of destruction inside the residence. Diana Resendiz told officers that her brother, Jose Resendiz, grabbed her by the throat and choked her during a verbal argument. When she told her daughter to call 911, the defendant grabbed her by the neck a second time saying, “You gonna call the police, then I’ll make it worth your while.”
Witnesses testified they had to physically separate the defendant from the victim, at which point the victim was able to run to a neighbor’s home to call for help. Jose Resendiz remained inside the house, throwing chairs, punching holes in walls and breaking picture frames. When officers entered the residence to talk to the defendant, they found the home in disarray and Jose Resendiz in a rage. Blood was splattered on the floor and walls from injuries the defendant sustained during his rampage.
Testimony revealed the argument started when the defendant alleged his sister was mistreating his children – by not letting them sit in the front seat of the car. Jose Resendiz was charged with felony family violence because of two prior convictions for family violence assault.
Resendiz was tried before Presiding Judge Brady Elliott. Family Violence Assault in this case is a third-degree felony with a punishment range of 2-10 years in prison and a fine up to $10,000. The defendant has elected for the judge to determine his sentence at a hearing scheduled for Nov.15.
